being at any Port in the Colony engages any Asiatic seamen who is a British subject to proceed to any port out of the Colony he shall enter into an agreement with such seaman and the agrae- -ment shall be made before a Port Officer in the manner herein- -before provided for the making of agreements in the case of foreign-going ships and all the provisions of section 38 respecting the form of such agreements and the stipulation to be contained in them and the making and signing of the same shall be applicable to the engagement of such seaman; and the master of such foreign ship shall give to the Port Officer a bond with the security of some approved person resident in the Colony for an amount calculated at the rate of fifty dollars for every such seaman and conditioned for the due performance of the said agreement and stipulations and for the repayment to the Crown of all expenses which it may incur in respect of any such Asiatic seaman who may be discharged or left behind at any port out of the Colony and becomes distressed and is relieved under
the provisions of the Merchant Shipping Acts.
